I can't get an HTC One X because the ITC is enforcing a patent injunction slapped on by Apple and is holding the phones up in customs. This pisses me off and here's why: Apple has no quantitative reason to make this move. It dwarfs HTC in revenues, profits, market share, market capitalization and brand recognition. This may be perfectly within Apple’s legal rights (due mostly to a questionable ruling by the ITC) but you have to beg the question: What is Apple really afraid of? Was HTC just an easy target? Is this a Sense UI (HTC) infringement or an Android (Google) one? If it is the latter, shouldn’t Apple be going after Google, Motorola and Samsung (just to name a few) over #5,946,647 as well? Oh, I see, those companies are too large and have sizeable patent portfolios of their own that could be brought to bare. HTC is small and struggling. Nothing like being on top and kicking a competitor when it is down. Wonderful business ethics from Cupertino, bravo! Did Apple even try to settle before going straight for the jugular I wonder? And what is wrong with the ITC on this ruling? Patent #5,946,647 is a MICROSOFT patent from 1990 that Apple re-patented simply because it is using it on a phone rather than on a laptop or desktop. Some innovation. And yes I blame the PLAYER. Just because you can get away with something doesn’t mean you should. What’s worse, is this feature, “data tapping” is not even a feature that is advertised as a differentiator on a smartphone. I challenge anyone, ANYONE to find the consumer who is attracted to the iPhone simply because it has data tapping. Please. I simply can not swallow that this injunction against HTC is simply a move in defense of Apple’s “[borrowed] intellectual property”, market position and financial performance. Are the shareholders of a company with a stratospheric market capitalization really that scared of the competition? Ha, right. What data supports that Apple’s reign is in any REAL trouble? This entire move speaks to me of fear and pettiness; fear that a smaller Taiwanese competitor might have finally come up with a device with the potential to shine as brightly as the vaunted iPhone. God forbid. You can come back at my rant (oh and this is without question a rant ) with all the Devil’s advocacy you want but it does not change the facts here. Which are: 1. Whether or not either the iPhone 4/4s or the One X has data tapping would make no difference with the average consumer. Especially, the kind of average consumer that is drawn to an iPhone through name recognition. 2. As great as the One X may be, HTC does not have the marketing machine in place to give the iPhone 5 a serious run within the U.S. market, regardless of what features it has or “borrows” from the iPhone. 3. Legal rights or not, Apple is Wal-mart, Exxon, Microsoft (take your pick of anti-competitive culprits) in this case. Cupertino has zero interest in fostering healthy competition in the marketplace that would ultimately benefit the consumer. Remember the consumer doesn’t know what it wants until Apple tells it. And here is something that has nothing to do with fact: Apple has pissed me off personally. I mean I don’t know what else you would call it. I want an One X. I want to take the money I have earned and spend on the object of my choice. A choice that has now been removed as a direct result of what Apple is doing. So go on and say “What, you don’t think HTC would not do the same thing to Apple?”. I’m sure it would but the FACT is HTC didn’t. Samsung didn’t. Google didn’t. One company and one company only is keeping me from the product I want to buy: Apple. So Apple has pissed me off. I know not only does it not care, it doesn’t matter at all that I’m angry. All I can do is NOT buy Apple products for myself …and in the interest of full disclosure, my wife uses an iPhone and I have no intention of talking her out of an iPhone 5. Why? Well Apple hasn’t pissed her off. She has no interest in a One X. She is also not a geek who gets too worked up over this sort of thing like some crazed revolutionary like her husband (I live for drama and saber rattling). I read one post, amongst the many attached to the many articles on this drama, that said if the amount of money Apple has been spending on litigation had been used to improve conditions at Foxconn and for R&D, we would all be comparing the iPhone 5 to One X right now, instead of dealing with this nonsense. TSA is the biggest waste of our tax dollars! The chemical sensor beeped after the officer did a pat down on me. The supervisor asked said officer if he checked his gloves before the check, he hadn't. While watching him unpack and search of all my luggage the supervisor and I witnessed another overpaid, under-qualified officer check 3 new pairs of gloves which all set off the machine. I really don't feel any safer - false positive could also just as easily be a false negative! Fix your machines!

This is the 2nd time in a row I went to Sur la Table in Canton,CT where the same 2 bitches....I mean ladies, REFUSE to assist me! Once again, I left my items on the counter after waiting (without attention) for a good 10 minutes. Wtf? Done with that store. All their shit is made in China, anyway.
